These Terms of Use govern your use of spaceberry.studio, a website owned by LLC SPACEBERRY STUDIO (“Spaceberry”, “Company”, “We”, “Our”), which also includes all related software development kit, widgets, tools, data, software, and other services provided by us (the “Services”).

This document, together with our Privacy Policy and any other terms specifically referred to therein, constitute a legally binding agreement (the “Agreement”) between you and the Company in relation to your use of our Services. If you do not agree with these Terms, do not use spaceberry.studio.

However, you do grant to LLC SPACEBERRY STUDIO and our affiliates a worldwide, nonexclusive, perpetual, global, royalty-free right and license (subject in all cases to the Privacy Policy) as set below:

  • with respect to Content other than photos, graphics, audio, video, or writing that you submit, post, or otherwise make available to public areas of the Services (e.g. not intended as a private communication), the license to use, reproduce, publish such Content (in whole or part) via the LLC SPACEBERRY STUDIO website and platform; and
  • with respect to photos, graphics, audio, video or writing, including community messages, content or other material posted in public areas of the applications, the license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display such Content for the purpose for which such Content was submitted, posted, or made available.

Your Personal Information

While using spaceberry.studio, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include but is not limited to your name (“Personal Information”).

Log Data

We collect information that your browser sends whenever you visit our Website (“Log Data”). 

This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of our Website that you visit, the time and date of your visit, the time spent on those pages and other statistics. In addition, we may use third party services such as Google Analytics that collect, monitor and analyze this.

Applicable Law and Jurisdiction

If a dispute arises between you and LLC SPACEBERRY STUDIO, our goal is to provide you with a neutral and cost-effective means of resolving the issue quickly. In the event of a dispute, we encourage you to contact us first to resolve your problem directly with us. You may contact us regarding any complaints or disputes in the “Contact us” section below in these Terms.

These Terms of Use shall be construed in accordance with and governed by the laws of Ukraine, without reference to their rules regarding conflicts of law. 

ANY DISPUTE, CLAIM OR CONTROVERSY ARISING OUT OF OR RELATING TO THIS AGREEMENT SHALL BE ADMINISTERED BY THE APPROPRIATE COURT IN UKRAINE.

This Privacy Policy describes the types of information that we collect through our website and what we do with that information.

Our website is designed to permit you to access our content without registering or providing personally identifying information.

Children should always get permission from their parents before sending any information about themselves (such as their names, email addresses, and phone numbers) over the Internet, to us or to anyone else. Our website is not directed at children under the age of 13 and we won’t knowingly allow anyone under the age of 13 to provide us any personally identifying information. If you’re under 13, please don’t provide any information about yourself on this website.

Types of Information We Collect

The information we gather falls into two categories: (1) information voluntarily supplied by visitors to our website, for example, when they subscribe to our email newsletter, or use the “Contact Us” function on the website to communicate with us; and (2) tracking information gathered as visitors navigate through our website, review our email newsletters and other email messages, and “like” or share content through Facebook, Twitter, LinkedIn (“Social Media Services”), or our “send page by email” function. This information may be collected directly by us or it may be collected by third-party service providers on our behalf. Third parties featured on or linked to by our website, such as advertisers (“Advertisers”) and others involved in displaying advertisements or promotional messages on our site or offering products and services through our site (“Ad Services Providers”), and Social Media Services may be gathering information as well, through processes we don’t control.  We currently use Google Analytics, Chartbeat and API’s Metrics for News to track overall site traffic and engagement and reserve the right to use similar services from other providers in the future.

Information You Voluntarily Supply

We may collect and store information that you voluntarily supply to us while on our website. This may include personally identifying information if you choose to provide it. In accessing and using the spaceberry.studio website, you may have the opportunity to voluntarily submit some or all of the following types of information:

  • Information included in correspondence you send to us through the “Contact Us” function available on our website.

You may interact with content on our website through social media plugins provided by Facebook, Twitter, Google and LinkedIn. If you wish to receive our email newsletter, you must provide us your email address; we’ll use your email address to send you the email newsletters you have requested.

We also may use your email address to contact you from time to time for customer service purposes or to send you administrative notices or other information about our website, as described above.

Disclosure to Third Parties

To help Advertisers (and their ad agencies) understand our audience and confirm the value of advertising on spaceberry.studio, we may present them with aggregate information on our audience and how our audience uses our website (for example, information on traffic to various pages within our website). We may provide similar information to foundations, corporate sponsors and others who may help fund our operations. This information does not identify you personally.

We may share the information that is collected through this website with our third-party service providers for purposes related to website administration and operation. In some cases, we may permit our third-party service providers to collect such information directly on our behalf. For example, this website uses third-party web analytics services, such as Google Analytics and Chartbeat, to help analyze how users use the website. These services use cookies and web beacons to collect non-personally identifying tracking data from our website on our behalf and then use that data to provide us with statistical reports on website activity.  When we send you email newsletters and other communications, the content of those communications comes from LLC SPACEBERRY STUDIO, but we use a service provider to actually send the emails since there are so many recipients.  Our service provider uses your name and email address to send these emails but is contractually prohibited from using this information for any purpose other than sending these emails on our behalf.  We also may share your email address, and if you have elected to share it, your name, with third-party email service providers that send newsletters and other communications on our behalf, but our contracts with these providers prohibit them for using this information for any purpose other than sending out these emails on our behalf.
